Terms of Service

Effective Date: December 9th of 2024

Welcome to Duke’s Poop n Scoop! These Terms of Service constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Duke’s Poop n Scoop (“Company,” “we,” “us,” or “our”). By scheduling or using our services, you agree to be bound by the terms outlined below. Please read them carefully.

1. Services Provided

Duke’s Poop n Scoop specializes in pet waste removal services. Our offerings include but are not limited to:

Recurring Pet Waste Removal Services: Weekly, bi-weekly, or other custom schedules.
One-Time Cleanup Services: For events, special occasions, or excessive waste cleanup.
Deodorizing and Sanitizing Services: Application of pet-safe sprays to neutralize odors (if selected).
Additional Services: Disposal of pet waste bags from property, yard inspection for pet-related debris, and other specialized tasks by request (subject to approval and additional fees).

We aim to maintain a clean and sanitary environment for your property, pets, and family.

2. Service Schedule

2.1. Recurring Services:

Service days are assigned based on availability and geographic location.
You will be informed of your designated service day during the onboarding process.

2.2. One-Time Services:

Appointments for one-time cleanups must be scheduled at least 48 hours in advance, subject to availability.

2.3. Holiday Adjustments:

Services scheduled on a public holiday may be rescheduled, and you will be notified at least one week in advance.

2.4. Weather Delays:

In the event of severe weather (e.g., heavy rain, snow, or extreme heat), services may be delayed or rescheduled for safety.
Clients will be notified of any schedule changes as soon as possible.

3. Access to Property

To ensure service efficiency, you agree to:

Provide Access: Keep gates unlocked or provide access codes/keys. If the technician cannot access the property, the service will be skipped, and no refunds will be issued.
Contain Pets: Ensure pets are contained indoors or in a separate area of the yard during service to protect both your pet and our staff.
Secure the Area: Remove large debris, toys, or obstacles that could impede our ability to clean thoroughly.

Failure to provide access may result in a missed service fee of $25.

4. Preparation for Service

4.1. Yard Condition:

Grass should be mowed to a reasonable height to allow waste visibility.
Excessive waste buildup (e.g., several months of accumulation) may require a preliminary cleanup, billed at $100 per hour.

4.2. Hazard Disclosure:

Notify us in advance of any potential hazards, including aggressive animals, broken fences, hazardous materials, or unsafe property conditions.

4.3. Exclusions:

We do not handle waste contaminated by parasites, maggots, or hazardous chemicals.

5. Fees, Payment, and Billing

5.1. Pricing:

Service fees are based on property size, number of pets, and service frequency. Quotes provided during onboarding will remain valid unless service conditions change.

5.2. Payment Terms:

Payments are due monthly and must be made via debit card or credit card.
Late payments may incur a $50 late charge.
If weekly service starts 2 billing weeks before the end of the month then customer is responsible to pay the next month along with the 2 final weeks of the current month to begin service to be eligible for the first service to be free.

5.3. Refund Policy:

Refunds are not provided for missed cleanings due to lack of access or Client cancellations with less than 24 hours’ notice.

5.4. Additional Fees:

Excessive waste or yard conditions requiring extended service time may incur additional charges of $100 per hour or visit.

6. Cancellations and Rescheduling

6.1. Client-Initiated Changes:

Services may be canceled or rescheduled with at least 24 hours’ notice. Failure to do so may result in a cancellation fee of $50.

6.2. Company-Initiated Changes:

The Company reserves the right to cancel or reschedule services due to weather, unsafe conditions, or emergencies. In such cases, Clients will be notified promptly, and no cancellation fees will apply.

7. Liability and Disclaimer

7.1. Limitations of Liability:

Duke’s Poop n Scoop is not responsible for:
- Damage to lawns or landscaping caused by pre-existing conditions.
- Waste missed due to overgrown grass, excessive debris, or hidden areas.
- Injuries caused by Client’s pets during service.

7.2. Property Damage:

Any damage caused directly by our technicians will be reviewed, and reasonable efforts will be made to resolve the issue.

7.3. Pet Health and Safety:

While we strive to ensure a clean environment, our services are not a substitute for proper pet healthcare. We do not accept liability for any health issues caused by waste accumulation.

8. Termination of Service

Either party may terminate the agreement with 14 days’ written notice.
The Company may terminate services immediately for repeated violations of these Terms, non-payment, or unsafe working conditions.

9. Privacy and Data Security

Personal information (e.g., contact details, payment information) will only be used for service purposes and will not be shared with third parties without consent.

10. Dispute Resolution

In the event of a dispute:

If an issue cannot be resolved amicably, both parties agree to mediation before pursuing legal action.

11. Modifications to Terms

Duke’s Poop n Scoop reserves the right to amend these Terms of Service at any time. Clients will be notified of any material changes in writing or via email. Continued use of services constitutes acceptance of updated Terms.
